End User License Agreement (EULA)

NOISEALCHEMY.COM

1. Purpose of the Agreement

This End User License Agreement (hereinafter the “Agreement”) sets forth the terms under which users (hereinafter the “User”) may access and use the sound effects, packs, and services provided on NOISEALCHEMY.COM (hereinafter the “Platform”).

By accessing, downloading, or using any sound content available on the Platform, the User fully and unconditionally agrees to the terms of this Agreement.

2. Ownership of Rights

All sound effects, packs, and audio content available on the Platform are and remain the exclusive property of Nicolas Jeudy and Dark Fantasy Studio.

These works are protected by copyright laws and international intellectual property treaties.

3. License Grant

Subject to compliance with the terms of this Agreement, NOISEALCHEMY.COM grants the User a license that is:

• Non-exclusive
• Worldwide
• Non-transferable
• Perpetual

This license allows the User to:

• Incorporate the sound effects and derivative works created from the packs into personal or commercial projects (video games, films, series, advertisements, podcasts, stage productions, multimedia installations, etc.);
• Modify, mix, and transform the sound effects to create new sounds, which may be used in the aforementioned projects.

4. Restrictions

The User is strictly prohibited from:

• Reselling, redistributing, renting, lending, transferring, or making the raw sound effects from the packs available for download, whether free or paid;
• Including the raw or slightly modified sound effects in a sound library, sound pack, software, application, or any product whose main purpose is to provide standalone audio resources;
• Claiming authorship or ownership of the original sound effects.

5. Mandatory Attribution

The User agrees to clearly credit, at least once within their project (in the credits, end titles, or description), the following notice:

“Sound effects created with NOISE ALCHEMY – NOISEALCHEMY.COM”

6. Disclaimer of Warranty

All sound content is provided “as is,” without any warranty of suitability for a particular purpose.

NOISEALCHEMY.COM, Nicolas Jeudy, and Dark Fantasy Studio shall not be held liable for any direct or indirect damages arising from the use of the sound effects.

7. Termination

In case of violation of this Agreement, the license shall be automatically terminated without prior notice or compensation.

The User must immediately cease all use of the sound effects and delete all copies in their possession.

8. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of France.

Any dispute relating to its interpretation or performance shall be submitted to the competent courts of Brest, France, unless otherwise required by mandatory legal provisions.

9. Acceptance

By accessing, downloading, or using any sound effect available on the Platform, the User acknowledges having read, understood, and unconditionally accepted all provisions of this Agreement.
